Bokshuis General Terms and Conditions
General terms and conditions, applicable to the registration for Pads-/Boxing training and/or (small) group classes or other activities offered by Bokshuis.
Article 1 - Applicability of the Terms and Conditions
These terms and conditions are applicable when a participant registers for Pads-/Boxing training and/or (small) group classes or other activities offered by Bokshuis.
Article 2 - Membership
Membership is ongoing. The minimum duration of the membership is 6 months, starting from the 'Commencement Date of Agreement' mentioned in the contract. After the expiration of these 6 months, termination can be done with one month's notice via email or the (Virtuagym) app. If you do not cancel, you are obligated to pay the membership fee even if you do not participate in the classes. After the initial term, the membership is automatically extended indefinitely. Termination is possible with one calendar month's notice, calculated from the end of the current subscription period.
Article 3 - Registration, Enrollment, and Placement
The registration form must be completed truthfully and signed. The participant who registers for Pads-/Boxing training and/or (small) group classes or other activities offered by Bokshuis must, if applicable, inform the trainer before the start of the class about any health problems or the existence of a medical risk associated with participating in group training sessions. In case of failure to make this notification, the participant enters the class entirely at their own risk, and Bokshuis is in no way responsible for participation in the group training sessions.
Article 4 - Billing/Payments
The amount specified in the agreement must be paid in cash, by automatic debit, or by transfer within 14 days after the invoice date. It is not possible to pay the amount in installments unless otherwise agreed. In case of late payment, the agreement can be terminated by Bokshuis. In this case, the costs incurred by Bokshuis will be borne by the participant. Participants can sign up for group classes by purchasing credits through the website/app. These credits are valid for up to 3 months from the date of purchase; afterward, the credits expire.
Article 5 - Membership Fees
Bokshuis reserves the right to increase membership fees based on economic factors (inflation according to the Central Bureau for Statistics consumer price index) and fiscal developments (taxes and levies).
Article 6 - Liability
Bokshuis advises that you have a medical examination of your health before you start training at Bokshuis. Participation in the classes is entirely at your own risk. The use of personal protective equipment is mandatory and entirely the participant's responsibility. Bokshuis disclaims any liability for damage, injury, theft, or any other damage-causing event. The undersigned declares not to use or misuse the acquired knowledge to inflict injury on others or to misuse martial arts in any way. Furthermore, the participant will indemnify Bokshuis against claims from third parties in this regard.
Article 7 - Substances
The use of alcohol, drugs, and/or other stimulants within Bokshuis or being under their influence is strictly prohibited. Immediate removal from the gym and withdrawal of membership will inevitably follow the conditions mentioned in Article 2 of these General Terms and Conditions.
Article 8 - Cancellation
Bokshuis always operates by appointment, which is agreed upon in consultation with the participant. Cancellations must be made 24 hours before the agreed time of the respective personal training appointment. However, the rescheduled appointment must be made within 7 days in consultation. If this is not possible due to identifiable circumstances, the trainer and the participant will discuss the options for a new appointment. If the participant does not cancel a training appointment or part thereof within 24 hours before the agreed time of the respective personal training appointment, Bokshuis will charge the applicable costs. After registering for a group class, cancellation 3 hours before the start of the training (while retaining the credit) is not possible. If you cancel 3 hours before the start of a group class, the credit for that class will expire.
Article 9 - Changes
Address changes must be immediately communicated by the participant (via email or Virtuagym app) to Bokshuis. In case of non-compliance with this obligation, letters sent to the participant in accordance with article 3:37 paragraph 3 of the Dutch Civil Code shall have normal effect, even if the participant does not receive them. If the participant moves to a location that is 20 km or more away, the membership can be terminated with one month's statutory notice. Proof of relocation is required in this case.
Article 10 - Behavioral Rules during Training
Without prior permission from Bokshuis, training appointments or any part thereof may not be attended by third parties. The participant will always be present on time (at least ten minutes) before the start of the training appointment and will make an effort to follow the training instructions of the personal trainer/group class trainer correctly.
Article 11 - Disputes and Applicable Law
Dutch law applies to all agreements between Bokshuis and a counterparty. All disputes arising from or related to agreements between Bokshuis and a counterparty, to which these terms and conditions apply and which do not fall within the jurisdiction of the subdistrict court, shall initially be settled by the court with jurisdiction in the location of Bokshuis. This provision does not affect Bokshuis's right to bring the matter before a court that is competent according to the applicable normal jurisdiction rules.
Article 12 - Privacy and GDPR
When you register, the personal data you provide is processed and stored by Bokshuis. This processing is aimed at making your data available in your personal training software and entering your contract into our member administration. Your data will only be entered into software of confidential partners of Bokshuis. By signing your registration form, you give your consent for this processing. You always have the right to access your data. If you want to delete your data, you can request it in writing. We will retain your data during your membership and for a period of 7 years thereafter.
