Bokshuis General Terms and Conditions – Locations Leiden and Alphen
General terms and conditions applicable to registration for personal training, (small) group lessons, or other activities of Bokshuis at the locations Leiden and Alphen.
Article 1 – Applicability
These general terms and conditions apply from the moment a participant registers for personal training, (small) group lessons, or other activities of Bokshuis.
Article 2 – Membership
Membership is continuous. The minimum duration is one year, commencing on the 'Start Date of Agreement' stated in the agreement.
After this period, the membership will be automatically extended for an indefinite period.
Termination must be made via email, with a notice period of one calendar month.
Termination must be received no later than the first day of the next calendar month.
If no timely termination takes place, the participant remains liable for the membership fee, even in the case of non-participation in lessons.
Article 3 – Registration, Enrollment, and Placement
The registration form must be completed truthfully and signed.
Participants must notify the trainer before the start of the first lesson of any health problems or medical risks.
Failure to report such issues means participation is entirely at the participant's own risk, and Bokshuis is not liable.
Article 4 – Billing and Payments
Payment for group lessons is made via automatic direct debit.
Payment for personal training subscriptions can be made via automatic direct debit, payment link, or cash, in consultation with Bokshuis.
It is not possible to pay in installments unless otherwise agreed.
If a payment cannot be debited and the participant does not respond to payment requests, Bokshuis will be forced to engage a collection agency. The costs will be borne by the participant.
Participants can register for group lessons via credits in the app/website. Credits are valid as long as the contract is active.
Article 5 – Membership Fees
Bokshuis reserves the right to increase membership fees based on economic (inflation) and tax developments.
The exception is the Bokshuis Vriend subscription, which will not be increased.
Article 6 – Liability
Participation in lessons is entirely at the participant's own risk.
Wearing personal protective equipment is mandatory.
Bokshuis disclaims any liability for damage, injury, theft, or other damage-causing events, except in cases of intent or gross negligence.
The participant indemnifies Bokshuis against claims from third parties.
Article 7 – Prohibited Substances
The use of alcohol, drugs, or other stimulants within Bokshuis, or participation under the influence of such substances, is strictly prohibited. This will result in immediate termination of membership as outlined in Article 2.
Article 8 – Cancellations and Rescheduling (Personal Training)
Personal training is by appointment, arranged with the trainer.
Cancellations must be made at least 24 hours before the scheduled session.
If the cancellation is made on time, the session can be rescheduled within 7 days. The participant is responsible for this.
If canceled within 24 hours, the session will be fully charged.
If the trainer is unable to provide the session, it will not be charged.
For holidays, the participant can receive a 25% discount on one subscription month once per calendar year, regardless of the number of missed sessions. The holiday period does not need to be reported in writing; a message via WhatsApp or another communication method is sufficient.
Article 9 – Changes
Address changes must be reported to Bokshuis exclusively by email.
If this obligation is not met, sent letters remain legally valid under Article 3:37 paragraph 3 of the Dutch Civil Code.
Article 10 – Code of Conduct
Participants must be present on time (at least ten minutes before the start) and follow the trainer's instructions. Participation by third parties is not allowed without prior permission from Bokshuis.
Article 11 – Disputes and Applicable Law
Dutch law applies to these terms and conditions. Disputes will be submitted to the competent court in the location of Bokshuis, except for mandatory provisions.
Article 12 – Privacy (GDPR)
Upon registration, personal data will be processed and stored. This is done solely for training purposes and with Bokshuis's trusted partners.
Participants have the right to access, correct, or delete their data at any time. Data is retained for the duration of membership and up to 7 years thereafter in accordance with tax obligations.
Article 13 – Class Passes (Group Lessons and Personal Training)
A class pass for group lessons or personal training is valid for a maximum of 4 months from the date of purchase.
Unused lessons expire after this period.
Article 14 – Additional Provisions for Personal Training Subscriptions 1-to-2 up to 1-to-4
For personal training subscriptions with multiple participants (1-to-2 up to 1-to-4), it is not possible to receive a discount if one of the participants misses a session or goes on holiday.
Each participant must continue to pay their normal subscription fee, regardless of absence.
If one of the participants cancels their subscription, the rates for the remaining participants will be adjusted. The current rates for these subscriptions can be obtained from Bokshuis.
